Terms of Service

These Terms of Service (“Terms”) govern your use of the Treekeeper mobile game, treekeepergame.com, and the associated real-tree programme (together, the “Service”).

The Service is operated by:

1. Acceptance of the Terms

By downloading, accessing, or using Treekeeper, you agree to these Terms and acknowledge the Treekeeper Privacy Policy. If you do not agree, do not use the Service.

When the app is downloaded through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement also applies. These Terms govern the Treekeeper game, rewards, website, and real-tree programme.

2. Eligibility and Parental Permission

Treekeeper is designed for a mixed-age audience and may be used by children. We do not impose a universal minimum age of 13.

If you are not legally able to agree to these Terms on your own where you live, a parent or legal guardian must review and agree to these Terms on your behalf and supervise your use of the Service. A parent or legal guardian who permits a child to use Treekeeper accepts responsibility for the child’s use of the Service.

Where local law requires parental authorization for consent-based data processing or for a particular feature, a parent or legal guardian must provide that authorization before the relevant processing or feature is used. Some features may be limited where the legally required authorization has not been provided.

The Service is offered only in countries and regions selected by us. Availability in one country does not guarantee future availability there or availability elsewhere.

3. The Service

Treekeeper is a free puzzle game in which players complete levels, earn virtual Water Drops, progress through tree milestones, and may qualify to be assigned a real tree.

Features may include level and endless gameplay, adaptive difficulty, virtual rewards and Water Drops, optional rewarded advertisements, anonymous cloud-based progress, assignment of a Tree ID, and real-tree photographs and milestone updates.

The Service does not currently include paid purchases, subscriptions, or paid financial services.

4. Anonymous Accounts

Treekeeper may create an anonymous account automatically. You are responsible for maintaining access to the device and app installation associated with that account.

Because no conventional username and password may be provided, deleting the app, losing the device, clearing application data, or losing the anonymous session may prevent account recovery. Restoration may not always be technically possible. You should keep a record of your Tree ID after one is assigned.

You must not attempt to access another player’s account or interfere with account security.

5. Virtual Items and Water Drops

Water Drops, lives, scores, rewards, levels, gems, and other in-game elements are virtual features with no monetary value.

They:

• are not money, cryptocurrency, securities, or property;
• cannot be sold, traded, transferred, or redeemed for cash;
• do not represent a charitable donation;
• do not create carbon credits, carbon offsets, environmental certificates, or tax benefits;
• may be adjusted where necessary to correct errors, fraud, abuse, or technical failures.

We may change game balance, difficulty, rewards, level structure, Water Drop requirements, or virtual-item availability when reasonably necessary to maintain or improve the Service. Changes will not remove mandatory consumer rights.

6. The Real-Tree Programme

Trees used in the programme are planted in advance on private land in Slovakia and are managed by Daniel Furčák.

When a player reaches the applicable Water Drop goal, the player is assigned a specific existing tree, receives a personal Tree ID, may receive a photograph of that tree in the app, and may choose an appropriate name for the tree.

Reaching the goal does not mean that a new tree is planted at that exact moment. It means that a previously planted tree is assigned to the player within the Treekeeper programme. Participation is personal and non-transferable.

7. Ownership of Trees

Assignment of a tree does not transfer legal or beneficial ownership.

The player does not receive:

• ownership or possession of the tree or land;
• a right to enter or access the private property;
• a right to harvest, remove, sell, or control the tree;
• carbon credits or other environmental rights;
• a financial, investment, inheritance, or security interest.

The tree and land remain the property of their respective legal owner. The Tree ID is a programme identifier and is not proof of property ownership.

8. Tree Names

You may be able to choose a name that will appear in the app and may be placed on a physical tag near the assigned tree.

Tree names must not contain offensive, hateful, sexual, threatening, or unlawful content; infringe intellectual-property or privacy rights; impersonate another person; include contact details or sensitive personal information; or expose a child’s full legal name or other identifying information.

We may reject, shorten, or remove an inappropriate name. Where reasonably possible, the player will be allowed to submit a replacement.

By submitting a tree name, you grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and place that name on a tree tag solely for operating and documenting the programme.

9. Photographs and Milestones

Tree photographs are intended to help players follow the development of their assigned tree.

Natural growth, weather, seasons, maintenance requirements, image processing, and technical availability may affect the tree’s appearance, the timing and quality of photographs, and the availability of an in-app update.

If an earned photograph cannot be delivered through the app, contact support@treekeepergame.com. After reasonable verification of the account and Tree ID, we will make reasonable efforts to provide the photograph by email.

Photographs may be cropped, resized, compressed, or framed for presentation in the app.

10. Damaged or Lost Trees

Trees are living organisms. Their health and appearance cannot be guaranteed.

A tree may be affected by disease, pests, weather, wildlife, accidents, maintenance, or other circumstances outside our reasonable control.

If an assigned tree dies or must be removed, we will make reasonable efforts to replace it with another tree and update the player’s programme record. A replacement may differ in species, size, age, appearance, or location.

We are not responsible for temporary differences in appearance or growth that are normal for living trees.

11. Time Limits and Inactivity

Some tree milestones must be completed within a stated period, including a possible 100-day period.

If the required Water Drops are not collected within the displayed period, the tree may leave the active programme and further in-app photo milestones may end. The player may be allowed to begin a new tree journey.

Game accounts and associated information are scheduled for deletion after 100 consecutive days of inactivity. Account deletion may permanently remove progress and the connection between the account and its Tree ID.

Legal ownership and management of the physical tree remain unaffected by deletion of the game account.

12. Advertising

Treekeeper may display optional rewarded advertisements through Google AdMob or another disclosed provider.

Watching a rewarded advertisement may grant an in-game reward. Advertising availability is not guaranteed. A reward may be withheld if the advertisement was not completed, the provider could not verify completion, a network or technical failure occurred, or fraud, automated interaction, or manipulation is suspected.

Children and teenagers will receive age-appropriate, non-personalized advertising. Eligible adults may receive personalized advertising only where legally permitted and subject to required consent.

Ads are provided by third parties. We do not endorse every advertised product and are not responsible for transactions between you and an advertiser. The app will provide a way to report inappropriate or age-inappropriate advertisements where required.

13. Acceptable Use

You must not:

• cheat, automate gameplay, manipulate rewards, or exploit errors;
• modify, reverse engineer, or interfere with the Service except where law expressly permits it;
• bypass advertising, security, or age-protection measures;
• access servers or data without authorization;
• distribute malware or disrupt the Service;
• use the Service for unlawful, abusive, or fraudulent purposes;
• falsely represent ownership of an assigned tree or land;
• use Treekeeper branding or tree photographs commercially without permission.

We may suspend access, remove rewards, or terminate an account where we reasonably believe these rules were materially violated.

14. Intellectual Property

The Treekeeper name, game, software, artwork, graphics, audio, levels, text, designs, and related materials are owned by or licensed to the operator and are protected by applicable law.

Subject to these Terms and the Apple Standard EULA, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app for non-commercial entertainment. No ownership of the Service or its intellectual property is transferred to you.

15. Service Availability and Changes

We aim to keep the Service available, but uninterrupted or error-free operation is not guaranteed.

We may reasonably maintain, update, or redesign the Service; add, change, suspend, or remove features; change available countries; correct errors and game balances; or discontinue the Service where continued operation is no longer reasonably possible.

Where a material change affects consumer rights or an active tree programme, we will provide reasonable notice where practicable and comply with applicable law.

16. Third-Party Services

Treekeeper relies on services supplied by third parties, including Apple, Supabase, Google AdMob, Google Analytics, hosting providers, and network operators.

Their services may be governed by separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

17. Disclaimer

To the maximum extent permitted by law, the Service is provided on an “as available” basis.

We do not guarantee uninterrupted or error-free gameplay, that every device will remain compatible, continuous availability of advertisements, a specific tree-growth rate or appearance, exact photograph delivery dates, or that progress can always be recovered after loss of an anonymous account.

Nothing in these Terms excludes warranties or remedies that cannot legally be excluded under applicable consumer law.

18. Limitation of Liability

Nothing in these Terms limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited.

Subject to those exceptions, we are not responsible for indirect or unforeseeable losses arising from loss of anonymous account access, temporary service interruption, third-party services, ordinary changes in a living tree, or use of the Service contrary to these Terms.

These limitations do not reduce mandatory rights available to consumers in their country of residence.

19. Suspension and Termination

You may stop using the Service at any time and may request deletion of your data.

We may suspend or terminate access if you materially violate these Terms, engage in fraud or unauthorized access, suspension is necessary for security or legal compliance, or the Service is discontinued.

Where appropriate, we will provide notice and a reasonable opportunity to address the issue. Provisions concerning ownership, intellectual property, disclaimers, liability, and dispute resolution survive termination where legally appropriate.

20. Governing Law and Disputes

These Terms are governed by the laws of Slovakia.

If you are a consumer, this choice does not deprive you of mandatory protections provided by the laws of your country of residence.

Please contact us first so that we can try to resolve a concern informally. You may also use any consumer complaint or alternative-dispute-resolution mechanism available under applicable law. You retain the right to bring a claim before a competent court.

21. Changes to These Terms

We may update these Terms to reflect changes to the Service, providers, programme, or applicable law.

The updated Terms will be published on treekeepergame.com with a new effective date. Where legally required, we will provide additional notice or request acceptance before a material change takes effect.
